Win Win Solution dalam Penyelesaian Kredit Bermasalah
Abstract
This study aims to analyze the settlement of problem loans in a win-win solution. Non performing loans are the consequences that banks face in conducting business. Distribution of credit to the community in an eflort to improve the welfare of the community contains a very high risk. The problem approach used in this research writing consists of 3 (three) approaches, namely statute approach, conceptual approach. and comparative approach. Statutory approaches are used to examine and criticize the laws and regulations which in their interpretation there are still deficiencies in the case of Troubled Credit Settlement through Litigation and Non Litigation. Through litigation such as a district court, commercial court (lawsuit bankruptcy) or state afiizirs agency (if a state-owned bank) or non-litigation, such as arbitration. 0n the basis of various considerations, debtors and banks are trying to overcome these problem loans prefer credit restructuring The results of the research indicate that the settlement of problem loans gives more benefits for the parties, including: the settlement cost, the shorter settlement time, using the mechanism set by the regulatot; the two parties can take the same role. and the settlement is not win or lose but win-win solution
